User Generated Content Full Terms & Conditions

Hillarys reaches out to social media users to seek their permission to feature our favourite content on our various sites, social channels, and various promotional materials. You are reading this because Hillarys has requested your permission to use your social media content in this way.

These terms and conditions apply to our use of any words, pictures, images, data, information or any other ‘user generated content’ (“Content”) that you upload, post or share using third party websites or platforms including but not limited to Instagram, Facebook, Pinterest, YouTube and Twitter (the “Third Party Platforms”) and which we use on our website, in other marketing channels or in any Hunter Douglas owned social media platforms (“Hillarys Marketing”). Hillarys reserves the right to alter these terms & conditions without advance notice by posting revised terms & conditions. Accordingly, you should review the terms & conditions each time you grant permission or authorisation to feature your Content.

User Content Licence

If we would like to use your Content in any Hillarys Marketing, we will contact you on the relevant Third Party Platform to ask to use your Content or direct you to the following page: https://www.hillarys.co.uk/static/myhillaryshome-competition/. We will ask you to reply to us with the hashtag “#yeshillarys” on social media or tick any relevant 'Terms and Conditions' or 'Rules' boxes on the website if you agree to allow us to use your Content in Hillarys Marketing. By using the #yeshillarys hashtag or ticking the 'Terms and Conditions'/'Rules' box you agree to be bound by these terms and conditions as well as the terms of use of any relevant Third Party Platform.

You must respond directly to us within the same chat, thread or by private message using the hashtag “#yeshillarys” in order to agree to release the agreed Content to us. If we do not receive your response within 7 days from the date we contacted you, we will assume that you do not agree to our use of your Content and your Content will not be used by us in any Hillarys Marketing.

By agreeing to our use of your Content, You hereby agree and represent and warrant that (i) you are solely responsible for your Content, (ii) you own all rights in and to your Content and/or have obtained appropriate rights and permissions from any and all other persons and/or entities who own, manage or otherwise claim any rights with respect to such Content, (iii) you are not a minor, (iv) the Licensed Parties’ use of your Content as described herein will not violate the rights, including but not limited to copyright, trademark, patent, trade secret, privacy, publicity, moral, proprietary or other rights, of any third party, or any law, rule or regulation, and (v) the Content is not libellous, defamatory, obscene, pornographic, abusive, indecent, threatening, harassing, hateful, or offensive or otherwise unlawful.

You hereby grant to Hillarys and its related companies, agents, licensees, sub-licensees, contractors, successors, legal representatives, assigns, and third-party service providers, and their respective retail partners, marketing or public relations agencies, and other affiliates ( “Licensed Parties”) a worldwide, perpetual, irrevocable, royalty-free, fully-paid, non-exclusive, transferable, sub-licensable right to use your Content in any manner to be determined in the Licensed Parties’ sole discretion, including but not limited to on webpages and social media pages operated by the Licensed Parties, in promotional e-mails and advertisements, and in any and all other marketing, promotional and advertising initiatives, and in any media now or hereafter known. The Licensed Parties may use, display, reproduce, distribute, transmit, create derivative works from, combine with other materials, alter and/or edit your Content in any manner in their sole discretion, with no obligation to you whatsoever.

You grant the Licensed Parties the right to use your username, real name, image, likeness, descriptions of you, location, price of product or other identifying information, including but not limited to your voice, in connection with any use of your Content.

You accept that we may choose not to use your Content or to remove your Content from any Hillarys Marketing at any time. You agree that you will not receive any payment or other remuneration if we use your Content in any Hillarys Marketing.

These terms are governed by English law and any disputes in relation to them are subject to the exclusive jurisdiction of the English courts.

Additional Terms

These terms & conditions apply to the entire Hillarys website, the Hillarys Properties and Hillarys Services and to your Content unless otherwise provided. In addition, to the extent your Content is displayed on the website or on any of the Hillarys Properties or in connection with the Hillarys Services, you also will be subject to additional terms of use, agreements, guidelines or rules provided by Hillarys applicable to such Hillarys Services and Content, including but not limited to those set forth on the Hillarys website at https://www.hillarys.co.uk/terms-conditions/, and you hereby agree to be bound by such additional terms of use or service, agreements, guidelines, instructions or rules provided or posted by Hillarys (the “Hillarys Terms & Conditions”).

Entrants must have made a purchase and had a Hillarys window furnishing fitted – made-to-measure blinds, curtains and shutters – between 1st January 2022 and 31st December 2022. The competition closes at 23:50 on 31st December 2022. Entries received after this date will not be considered.
A winner will be chosen at random every quarter. The quarterly winners will be chosen on: 8th April, 8th July, 7th October and 6th January 2022 for each quarter. The winner will receive the value of their original order (up to a maximum value of £800.00) usually via the original payment method.
The Competition is not open to employees of Hillarys or their immediate families, or anyone connected with the running of this competition. Entrants must be 18 or over.

By submitting your photo, you warrant and represent that (i) you own the rights to the photo or, if the photo is subject to third party rights, that you have all required licenses, rights, consents and permissions to publish the photo and grant the necessary rights, that (ii) you are over 18 years of age and (iii) that the window furnishing featured in the photo is owned by you and was purchased on or after the 1st January 2022.
One winner will be announced per quarter, on the following dates 23rd April, 29th July, 21st October and 27th January 2023 through a dedicated post on the Hillarys Instagram page. The winner will be asked to get in touch with Hillarys using the email address [email protected] / by direct messaging the Hillarys Instagram page to arrange to receive the value of their order.
Re-posts outside of these dates on the Hillarys Instagram feed or on Hillarys’ Instagram Stories of customer’s entries does not constitute as an announcement or an acknowledgement of that customer winning the prize for that quarter.
If after reasonable attempts the winner cannot be contacted, Hillarys reserves the right to offer a prize to another entry chosen at random.
The prize as stated is not transferable. The value of an order cannot exceed £800.
The winner will receive their prize within 60 days of being notified.

Unsuccessful entrants will not be contacted and no feedback on any entry will be provided. The judges' decisions will be final and no correspondence will be entered into.

The prize is defined as the cost of your order up to the value of £800 from the Hillarys range. Entrants must be 18 or over.

The entry mechanism requires users to post images of their Hillarys Window furnishing on to their Instagram page and tag Hillarys (@hillarysblinds). The posts must include the hashtag: #myhillaryshome.

By including the hashtag #myhillaryshome in your post you agree to our terms and conditions. Any personal data collected will be processed in accordance with our Privacy Policy: https://www.hillarys.co.uk/privacy-policy/.

If chosen to be featured your social media handle will be displayed alongside your photo.

To qualify for entry into the competition, claimants must have made a purchase - and had fitted a Hillarys window furnishing – made-to-measure blinds, curtains and shutters on or before the end of each quarter (31^st March, 30th June, 30^th September and 31^st December 2019). A customer’s entry is only valid if their original purchase was made between 1^st January 2019 and 31^st December 2019.

By submitting your photo, you warrant and represent that (i) you own the rights to the photo or, if the photo is subject to third party rights, that you have all required licenses, rights, consents and permissions to publish the photo and grant the necessary rights, that (ii) you are over 18 years of age and (iii) that the window furnishing featured in the photo is owned by you and was purchased on or after the 1^st January 2019.

Winners will be chosen once a quarter. Winners will be decided by at random on the following dates: 8^th April, 8^th July, 7^th October and 6^th January 2020 for each quarter. Entries must be submitted each quarter. The competition closes at 23.59 on 31^st December. Entries received after this date will not be considered.

One winner will be announced per quarter, on the following dates 22^nd April, 12th August, 14^th October and 13^th January 2020 through a dedicated post on the Hillarys Instagram page. The winner will be asked to get in touch with Hillarys using the email address [email protected] / by direct messaging the Hillarys Instagram page to arrange to receive the value of their order.

Re-posts outside of these dates on the Hillarys Instagram feed or on Hillarys’ Instagram Stories of customer’s entries does not constitute as an announcement or an acknowledgement of that customer winning the prize for that quarter.

#MyHillarysChristmas Competition – Terms & Conditions: November 2022

Hillarys is looking to give one individual the opportunity to win back the cost of their order. A panel of judges from Hillarys will choose the winner and arrange to have the customer reimbursed for the cost of their most recent order. The competition will go live on 17^th November on the Hillarys Instagram page (https://www.instagram.com/hillarysblinds) in the form of a post.

The competition will run from 17th November 2022 to 16th December 2022.

TERMS & CONDITIONS

The competition is open to residents of England, Scotland, Wales and Ireland.
The Competition is not open to employees of Hillarys or their immediate families, or anyone connected with the running of this competition.
The prize consists of Hillarys reimbursing the customer for the cost of their most recent order up to the value of £7,500 for customers in the UK, or €7,500 for customers in Ireland.
The entry mechanism requires users to tag us in a reel showcasing a window/room that they’ve transformed for Christmas; comments must include the #MyHillarysChristmas
For an extra entry to the competition users can re-post their reel to their Instagram story, tagging @hillarysblinds and #MyHillarysChristmas
The competition closes at 23:59 on 16th December 2022. Entries received after this date will not be considered.The winner will be announced on 20th December in the form of a post on the Hillarys Instagram page. The winner will be asked to get in touch with Hillarys using the email address [email protected] / by direct messaging the Hillarys Instagram page to arrange the reimbursement of their most recent order.
The winner must contact Hillarys by 1st September 2023.
If after reasonable attempts the winner cannot be contacted, Hillarys reserves the right to offer a prize to the next best entry.
